Welcome to SleepWell. By downloading, installing, or using the SleepWell mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Description of Service

SleepWell is a sleep tracking and relaxation application that provides sleep monitoring, sound mixing, guided meditation, and smart alarm features. The App is available in a free version (with advertisements) and a premium subscription version (ad-free with additional features).

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. Health Disclaimer

SleepWell is a wellness application, not a medical device. The App is designed to help you understand your sleep patterns and promote better sleep habits. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The sleep data and scores provided by the App are estimates and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with questions about a medical condition or sleep disorder.

4. Subscription & Billing

SleepWell offers an optional premium subscription that unlocks additional features and removes advertisements. Subscription details:

• Subscriptions are billed through your Google Play account.
• Payment will be charged to your Google Play account upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Google Play account settings.

5. Free Version & Advertising

The free version of SleepWell displays third-party advertisements served by Pangle (ByteDance). By using the free version, you consent to the display of such advertisements. We are not responsible for the content of third-party advertisements.

6. User Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works of the App.
• Use the App for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the App's functionality.
• Attempt to bypass any subscription verification or payment mechanisms.

7. Intellectual Property

The App, including its design, code, graphics, audio content, and all other elements, is owned by SleepWell and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by law, SleepWell shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. This includes, but is not limited to, damages for loss of data, loss of sleep, or health-related issues. The App is provided "as is" without warranties of any kind, either express or implied.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle your data. SleepWell stores all sleep and personal data locally on your device — we do not collect or have access to your data.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify users of material changes through an in-app notice.

11. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate these Terms at any time by uninstalling the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in a court of competent jurisdiction, as specified by applicable law.
